1. Acceptance of Terms

By creating an account, accessing, or using the Herfeh mobile application ("App"), you agree to be legally bound by these Terms & Conditions ("Terms").

These Terms should be read together with the Herfeh Privacy Policy, which explains how we handle your personal data and forms part of your agreement with us.

If you do not agree, you must not use the App.

2. Platform Nature & Role

Herfeh operates a technology marketplace platform that connects users with independent sellers, and arranges the delivery of orders placed through the platform.

• Herfeh is not a merchant, manufacturer, or food producer.
• Products are prepared and supplied by independent sellers.
• Sellers are responsible for the quality, safety, legality, and accurate description of their products.
• Herfeh does not own, produce, or modify any listed product.
• Herfeh collects payment on behalf of sellers and charges sellers a commission on each order.

Herfeh is responsible for arranging delivery and for providing customer support in relation to orders placed through the App.

3. Eligibility

You must be at least 18 years old to use the App. By registering, you confirm that you meet this requirement.

4. Account Responsibility

You are responsible for:

• the accuracy of the information you provide
• maintaining the security of your device and your mobile number
• all activity that takes place under your account

Herfeh may suspend or terminate an account where misuse or a violation of these Terms is reasonably suspected.

5. Orders & Contract Formation

An order is submitted, but not accepted, when you press "Place Order."

A legally binding transaction is formed only when Herfeh confirms the order.

Preparation times and delivery times shown in the App are estimates provided in good faith. They are not guaranteed and do not form part of the contract.

Herfeh reserves the right to:

• reject an order
• cancel an order
• modify order details where operationally necessary

Where an order is rejected or cancelled by Herfeh after payment has been taken, that payment is refunded in full.

6. Pricing & Payments

Product prices are set by sellers. Herfeh does not mark up product prices.

The delivery fee is set by Herfeh and shown to you before you confirm your order.

The total price at checkout may include:

• item price
• add-ons
• delivery fee
• applicable taxes

Payments may be processed by third-party payment providers. Herfeh is not responsible for failures, delays, or errors caused by a payment processor, and any dispute concerning the processing of a payment may need to be raised with that processor.

Where you select cash on delivery, you are responsible for having the correct amount available at the time of delivery. Repeated failure to pay on delivery may result in suspension of your account.

7. Refunds

Refund decisions are made by Herfeh on a case-by-case basis, taking into account the nature of the issue, evidence provided, and the circumstances of the order.

A refund may be issued through:

• the original payment method
• bank transfer
• another method agreed with you

Users are not automatically entitled to a refund in every circumstance.

Nothing in this section limits or excludes any right you have under the consumer protection laws of the Hashemite Kingdom of Jordan.

8. Cancellation

You may cancel an order within 10 seconds of placing it, using the cancellation control shown in the App.

After that window:

• cancellation is not guaranteed
• Herfeh may allow cancellation at its discretion, for example where the seller has not yet begun preparation
• where an order has already been prepared or dispatched, a cancellation may not be possible and the order may be charged in full

Herfeh may cancel an order at any time, including where a seller is unavailable, a product is unavailable, or delivery cannot reasonably be completed. Where Herfeh cancels a paid order, that payment is refunded in full.

9. Delivery

Delivery is arranged by Herfeh through a third-party logistics partner.

Responsibility is allocated as follows:

• Issues arising before the order is collected from the seller are assessed case-by-case between the seller and Herfeh.
• Issues arising after the order has been collected from the seller are Herfeh's responsibility, save where the issue arises from the condition of the product itself.

Once your order is on its way, the App shows you the delivery driver's location and telephone number so that you may contact them about the delivery. That number is provided for the purpose of that delivery only.

Delivery times displayed in the App are estimates and are not guaranteed.

You are responsible for providing an accurate delivery address and for being available to receive the order. Where delivery fails because you are unavailable or the address is incorrect, the order may be charged in full.

10. Seller Responsibility

Sellers are responsible for:

• preparation of the product
• ingredients and their accurate disclosure
• food safety and hygiene
• the accuracy of product descriptions, sizes, and photographs
• compliance with applicable laws and licensing requirements
• the integrity of packaging at the point of collection

Herfeh does not prepare, inspect, or test products. Subject to Section 16, Herfeh is not liable for defects in a product or for the consequences of consuming it.

11. Ratings & User Content

You may submit ratings and reviews about a seller.

Ratings and reviews are published anonymously. Your name is not displayed alongside your review.

By submitting content, you grant Herfeh a worldwide, perpetual, royalty-free licence to use, display, reproduce, and publish that content in connection with the platform.

You confirm that any content you submit is your own, is truthful, and does not infringe the rights of any other person.

Herfeh may remove content that is false, abusive, unlawful, or that breaches these Terms.

12. Prohibited Conduct

You may not:

• submit false or fraudulent claims
• abuse, harass, or threaten sellers, drivers, or Herfeh staff
• contact or use a delivery driver's telephone number for any purpose other than the delivery to which it relates
• use the platform for commercial resale of products
• manipulate ratings, whether your own or another party's
• attempt fraud, including fraudulent chargebacks
• interfere with, probe, or attempt to disrupt the platform's systems
• create multiple accounts to abuse promotional offers

Violation may result in immediate termination of your account and, where appropriate, legal action.

13. Promotions, Vouchers & Credits

Promotional vouchers, discount codes, and any credits issued by Herfeh:

• may carry an expiry date
• are non-transferable
• are not redeemable for cash
• may be limited to a single use per account
• may be revoked where misuse is reasonably suspected

Herfeh does not currently operate a consumer wallet. Where a wallet or credit balance is introduced in future, its terms will be published in the App.

14. Platform Rights

Herfeh reserves the right to:

• suspend or restrict a user account
• remove a seller from the platform
• cancel an order
• change the delivery fee
• change the products, sellers, or cities available on the platform
• update, modify, or discontinue features of the App

Changes to the delivery fee apply only to orders placed after the change takes effect. The fee shown to you before you confirm an order is the fee you will be charged for that order.

15. Third-Party Services

The App integrates services provided by third parties, including:

• payment providers
• mapping services
• SMS providers
• our delivery partner

Those services operate under their own terms and policies. Herfeh is not responsible for their acts, omissions, or policies.

16. Limitation of Liability

Nothing in these Terms excludes or limits Herfeh's liability for:

• death or personal injury caused by Herfeh's negligence
• fraud or fraudulent misrepresentation
• any other liability that cannot lawfully be excluded or limited under the laws of the Hashemite Kingdom of Jordan

Subject to the paragraph above, and to the maximum extent permitted by law:

• Herfeh's total liability arising out of or in connection with any order shall not exceed the total value of that order.
• Herfeh is not liable for indirect or consequential losses, loss of profit, or loss of opportunity.
• Herfeh is not liable for delivery delays caused by events outside its reasonable control.

17. Indemnification

You agree to indemnify and hold harmless Herfeh, its directors, employees, and partners from any claim, damage, or loss arising from:

• your misuse of the platform
• your violation of these Terms
• your violation of any applicable law
• a dispute between you and a seller, to the extent it does not arise from Herfeh's own act or omission

18. Force Majeure

Herfeh is not liable for any failure or delay caused by events beyond its reasonable control, including severe weather, strikes, war, government restrictions, internet or power outages, civil unrest, and transport disruption.

19. Account Termination

Herfeh may suspend or terminate your account where there is:

• reasonably suspected fraudulent or suspicious activity
• a pattern of chargebacks
• abuse of sellers, drivers, or staff
• a violation of these Terms

Where the reason for termination is prolonged inactivity, Herfeh will give you notice before the account is closed, where it is practicable to do so.

Termination does not affect any right or liability that accrued before it took effect.

20. Conflict of Terms

If any statement made by a seller conflicts with these Terms, these Terms prevail.

21. Electronic Consent

By pressing "Accept," registering, or continuing to use the App, you agree that:

• your action constitutes a legally binding electronic signature
• electronic records satisfy any legal requirement that an agreement be in writing

22. Intellectual Property

The Herfeh name, logo, App, and all content on the platform other than user content and seller product content are owned by Herfeh or licensed to it.

You may not copy, reproduce, distribute, reverse-engineer, or create derivative works from the App or its content without our prior written permission.

23. Privacy

Your personal data is handled in accordance with the Herfeh Privacy Policy, which is available in the App and forms part of your agreement with us.

24. Severability, Waiver & Assignment

If any provision of these Terms is found to be invalid or unenforceable, that provision is severed and the remaining provisions continue in full force.

A failure by Herfeh to enforce any provision is not a waiver of that provision.

Herfeh may assign or transfer these Terms, in whole or in part, to any successor entity or affiliate. You may not assign your rights under these Terms.

25. Changes to Terms

Herfeh may modify these Terms from time to time. Where a change materially affects your rights, we will notify you through the App before the change takes effect.

Continued use of the App after a change takes effect constitutes acceptance of the updated Terms.

26. Governing Law & Dispute Resolution

These Terms are governed exclusively by the laws of the Hashemite Kingdom of Jordan.

The parties shall first attempt to resolve any dispute through good-faith discussion. If the dispute is not resolved, it shall be submitted to the competent courts of Amman, Jordan.

27. Language

These Terms are published in Arabic and in English. In the event of any conflict or inconsistency between the two versions, the Arabic version prevails.
